Advertiser Service Agreement
Please read this Terms of Service Agreement CarefullyThe following Terms and Conditions apply to Shorepages.com which is owned and operated by Silver Bay Solutions LLC. Terms and Conditions for other services offered by Silver Bay Solutions LLC are set out on respective web sites owned and operated by Silver Bay Solutions LLC. Our company is only an advertising company. We do not provide legal, appraisal, or any other professional real estate services, nor do we employ any real estate professional such as Realtors or Brokers. The information on this site is not intended to serve as legal advice related to individual situations.
Terms and Conditions
By purchasing a service offered by ShorePages.com, you agree to these terms and conditions. If you do not agree to the terms and conditions of this agreement, you should immediately cease all usage of this website. We reserve the right, at any time, to modify, alter, or update the terms and conditions of this agreement without prior notice. Modifications shall become effective immediately upon being posted at Shorepages.com website. Your continued use of the Service after amendments are posted constitutes an acknowledgement and acceptance of the Agreement and its modifications. Except as provided in this paragraph, this Agreement may not be amended.All information you supply to ShorePages.com to the best of your knowledge is true and accurate;You are eighteen years of age or older.You are the legal owner or legal representative of the company or the property you are listing.If you are a broker/owner, you will disclose that fact in the ad.The content of your ad will not reference any other website with the exception of the listing company.The content of the ad will be lawful purpose only. Pornography and sex-related merchandising are prohibited. This includes information that may infer sexual content, or link to adult content elsewhere. This is also true for sites that promote any illegal activity or content that may be damaging to our servers or any other server on the internet. Links to such materials are also prohibited. This includes, but is not limited to: copyrighted material, material we judge to be threatening or obscene, or material protected by trade secret and other statute. In addition any site selling or promoting bulk email services is not allowed. Examples of non-acceptable content or links: Pirated software; Hackers programs or archives; Warez Sites; Irc Bots; MP3s or any other method of distributing copyrighted music/sounds. We will be the sole arbiter as to what constitutes a violation of this provision.Transmission, storage, or presentation of any information, data or material in violation of any United States Federal, State or City law is prohibited.
Fees and Refunds
If you cancel prior to 30 days, we offer a 100% refund. After 30 days we do not prorate the cost of our services for any reason. We are an advertising company and make no guarantees.All requests for refunds must be made in writing within 30 days of service.Our agreement with you also includes our currently applicable price list. The price list may change from time to time, but we will notify you of any changes when they happen. Copies of the price list are available from us, upon request.The Client must pay to Silver Bay Solutions LLC all fees in advance.
Password and User Account
You are solely responsible for maintaining the confidentiality of your password and user account information. If you suspect any unauthorized use of the account, it is your responsibility to promptly notify the company. We will not and cannot be liable for any loss or damage arising from your failure to adequately safeguard your user name and /or password, or to otherwise comply with this provision. You are entirely responsible for any and all activities which occur under your user account.
Changes to Listing
You have the ability to maintain the information of your listing to reflect any changes (e.g., Events, Sale Pending, or Price Reduction). You may log in to change information as needed 24 hours a day, 365 days a year.
Duration of Listing
Your listing remains active on ShorePages.com for the duration of the plan.
Renewal of Listing
Upon the ads renewal date, the customer must pay all fees due within 7 days. Failure to pay within 7 days may result in suspension of the ads.
Outages
The site is provided by Silver Bay Solutions LLC on an “as is” and on an “as available” basis. Silver Bay Solutions LLC makes no representations or warranties of any kind, express or implied, regarding the use or the results of this web site in terms of its correctness, accuracy, reliability, or otherwise. Silver Bay Solutions LLC shall have no liability for any interruptions in the use of this Website. Silver Bay Solutions LLC, disclaims all warranties with regard to the information provided, including the implied warranties of merchantability and fitness for a particular purpose, and non-infringement. Some jurisdictions do not allow the exclusion of implied warranties; therefore the above-referenced exclusion is inapplicable. Scheduled Maintenance – Silver Bay Solutions LLC must perform scheduled maintenance to servers from time to time. We will attempt to perform all scheduled maintenance at times that will affect the least amount of Clients.Unscheduled maintenance may be needed to be performed due to data corruption, service failure or equipment failure. Silver Bay Solutions LLC will endeavor to inform you via email with details of any outage.
Disclaimer
The services provided by Silver Bay Solutions LLC are expected to change as technology changes and systems are upgraded. Silver Bay Solutions LLC reserves the right to change any service offered or the feature of any service offered or its systems without notice, including changes to access and use procedures and all system hardware and software.The listing company agrees to indemnify and hold us harmless from any claims resulting from the use of the service, which damages the subscriber or any other party. Silver Bay Solutions LLC is not responsible for lost Content or lost User Content. Backups are intended for disaster recovery, not the restoration of individual files.Silver Bay Solutions LLC, expressly has the right to remove any listing from ShorePages.com if you are not in compliance with any policy in this Service Agreement.
